BURNETT COUNTY — The Court has sentenced a woman on two convictions for Operating While Intoxicated that were filed against her in Burnett County Circuit Court following two separate incidents that each occurred in 2019.
DrydenWire reported in October 2019, that Antoinette Bearheart was facing charges following an incident that occurred on September 10, 2019. The Minnesota State Patrol contacted the Burnett County Sheriff’s Department regarding a vehicle, identified as belonging to Bearheart, that had been involved in a hit-and-run in Pine County, MN. While attempting to locate Bearheart, law enforcement received another report from a different individual who stated that Bearheart’s vehicle had nearly run them off the road.
Bearheart was located and after a short pursuit, she stopped her vehicle. After attempting to complete field sobriety tests, Bearheart was taken into custody for operating while intoxicated. Bearheart’s preliminary alcohol breath test results were 0.254.
A criminal complaint was filed against Bearheart charging her with Class I Felony Attempting to Flee or Elude an Officer, Class G Felony Operating a Motor Vehicle While Under the Influence - 5th/6th Offense, and Class I Felony Bail Jumping
Charges of Class G Felony Operating While Intoxicated 5th or 6th Offense, and Class G Felony Operating With Prohibited Alcohol Concentration 5th or 6th Offense had previously been filed against Bearheart following an incident on July 27, 2019, according to online circuit court records.
A jury trial was scheduled for May 2021 on Bearheart’s charges, however, online circuit court records show that at a hearing in March 2021, the Court accepted Bearheart’s pleas of Class G Felony Operating While Intoxicated 5th Offense and Class G Felony Operating a Motor Vehicle While Intoxicated 6th Offense. The remaining charges filed against Bearheart were dismissed and read in.
Bearheart appeared on May 18, 2021, for a sentencing hearing and the Court ordered a withheld sentence, 3 years of probation, and 6 months of conditional jail time on each conviction, to be served consecutively. Conditions of probation will require Bearheart to maintain absolute sobriety, complete an OWI Assessment and Driver Safety Plan, and pay over $10,000 in court costs, fines, and fees.
