Single-Vehicle Rollover Crash Results In 6th Offense OWI Conviction

BURNETT COUNTY -- A single-vehicle rollover crash that occurred in Burnett County, WI on November 18, 2018, has resulted in a conviction of 6th Offense OWI for Bradley Foss, of Star Prairie, WI.

A criminal complaint filed against Foss in Burnett County Circuit Court states that on November 18, 2018, Burnett County Sheriff’s Deputies were dispatched to a single-vehicle rollover crash. When Deputies arrived on the scene they observed a pickup truck about 20 yards off into the ditch. The pickup truck had sustained severe damage, including a crushed roof. However, the truck was resting on its wheels and the driver was attempting to drive the truck out of the ditch.

Deputies made contact with the driver and observed signs of intoxication as well as open alcohol containers in the vehicle. The driver, identified as Bradley Foss, had a cut on his hand, but the criminal complaint does not list any other injuries sustained by Foss. Deputies spoke with Foss, who seemed "confused." Foss stated that he was traveling to Siren from St. Croix Falls, and then later said that he was traveling from Siren to Star Prairie. Emergency Medical Personnel examined Foss and cleared him medically, and Deputies transported him to Burnett Medical Center for a blood draw. Results of the testing on the blood sample showed that Foss had a blood alcohol level of .134.

Charges of Class G Felony Operating While Intoxicated 6th Offense and Class G Felony Operating With Prohibited Alcohol Concentration were filed against Foss. After numerous hearings, Foss’s case was scheduled for a jury trial in June 2021, however, online circuit court records show that Foss entered a plea of Guilty to the charge of OWI 6th Offense.

Foss appeared again on September 15, 2021, for a sentencing hearing on his conviction and the Court ordered a 4-year imposed and stayed sentence, with 2 years of probation and 6 months of conditional jail time. Foss was granted credit for 105 days of time already served in confinement.

If Foss’s probation should be revoked, Foss will face 2 years of initial confinement in state prison, followed by 2 years of extended supervision. Foss was ordered to complete an alcohol and other drug assessment and follow through with recommendations. The Court also ordered Foss to complete 100 hours of community service, maintain absolute sobriety, and pay over $3,000 in fines and costs.
