Shell Lake Man Pleads Guilty in Barron, Sawyer Counties to Amended Drug Charges

Shell Lake man Daniel McClaine has entered pleas in both Barron County and Sawyer County circuit courts regarding his multiple drug charges.

DrydenWire.com reported in October 2017 (see below) that McClaine was facing charges in both Barron County and Sawyer County circuit courts for charges of trafficking methamphetamine.

A lengthy investigation by Sawyer County law enforcement, coupled with an investigation by Barron County law enforcement, led to the arrest of McClaine. The Wisconsin Department of Justice, Division of Criminal Investigation, and the Washburn County Sheriff’s Office assisted in the investigations which involved the coordination of multiple controlled buys of methamphetamine.

According to online circuit court records, on March 14, 2018, McClaine entered into a Deferred Sentencing Agreement on his Sawyer County charge of Class I Felony Possession of Methamphetamine. Charges of Class F Felony Deliver Methamphetamine were dismissed.

At a hearing on April 13, 2018, in Sawyer County Circuit Court, McClaine plead guilty to reduced misdemeanor charges of Possess Amphetamine. Felony charges of Class F Felony Deliver Amphetamine, Class I Felony Possession of Methamphetamine, and Class H Felony Possess Drug Paraphernalia to Manufacture methamphetamine were dismissed but read in.

McClaine was ordered to serve 2 years of probation for his Barron County convictions. Conditions of his probation require him to maintain absolute sobriety and complete any and all evaluations, counseling, treatment and follow-up recommended by his probation agent.

The details of McClaine’s Deferred Sentencing Agreement in Sawyer County Circuit Court are not known to DrydenWire.com at this time.

An investigation in Barron County involving a series of controlled buys coordinated by law enforcement has resulted in multiple felony charges being filed against Shell Lake man Daniel McClaine.

DrydenWire.com reported earlier this year that McClaine had been arrested following an investigation in Sawyer County and that criminal charges had been filed against McClaine for trafficking methamphetamine in Sawyer County. These charges arose out of a 2-month long investigation by the Sawyer County Sheriff's Office, the Washburn County Sheriff's Office and the Wisconsin Department of Justice, Division of Criminal Investigation.

Online circuit court records show that on October 18, 2017, a new criminal complaint was filed in Barron County Circuit Court charging McClaine with felony methamphetamine-related charges.

The criminal complaint filed against McClaine states that in October, November and December of 2016 a series of controlled drug buys were coordinated by Barron County law enforcement in which confidential informants purchased methamphetamine from Daniel McClaine at a trailer home located in the Camelot Acres Trailer Park. A total of over 10 grams of methamphetamine was purchased from McClaine according to the criminal complaint.

The criminal complaint does not identify who the informants were who assisted with these controlled buys, but does state that at least 2 of the buys were monitored by audio recordings which allowed law enforcement to listen to the conversations held between the informant and individuals located within the residence in the trailer park.

A vehicle parked at the residence was confirmed as being registered to McClaine, the criminal complaint states, and when detectives took McClaine into custody in December 2016 and asked McClaine if he knew why he was being arrested, McClaine allegedly stated that he had a pretty good idea as to why, and that he figured he knew who had set him up.

It is not known to DrydenWire.com at this time if charges are filed against any of the other individuals who were at the residence during the controlled buys.

McClaine is charged with the following:

  • 1 count of Class E Felony Delivery of Methamphetamine (7.5 grams) – maximum penalty: 15 years imprisonment or a fine of $50,000 or both,
  • 1 count of Class F Felony Delivery of Methamphetamine (1.3 grams) – maximum penalty: 12 years & 6 months imprisonment or a fine of $25,000 or both,
  • 1 count of Class F Delivery of Methamphetamine (.2 grams) – maximum penalty: 12 years & 6 months imprisonment or a fine of $25,000 or both,
  • 1 count of Class F Delivery of Methamphetamine (2.1 grams) – maximum penalty: 12 years & 6 months imprisonment or a fine of $25,000 or both,
  • 1 count of Class I Felony Possession of Methamphetamine – maximum penalty: 3 years & 6 months imprisonment or a fine of $10,000 or both, and
  • 1 count of Class H Felony Possession of Drug Paraphernalia used to Prepare Methamphetamine (a scale) – maximum penalty: 6 years imprisonment or a fine of $10,000 or both.

McClaine is scheduled to appear on his Barron County charges in November 2017.

Online circuit court records show that on September 18, 2017, McClaine posted $10,000 cash bond regarding his Sawyer County charges which are 2 counts of Class F Felony Manufacture/Deliver Amphetamine (<=3grams), and 1 count of Class F Felony Possess w/Intent Amphetamine (<=3grams).

Court Denies Motion to Modify Bond for Shell Lake Man Charged with Drug Trafficking

Daniel McClaine appeared in Sawyer County Circuit Court while in custody on August 30, 2017, and the Court heard a Motion to Modify his bail bond which was set at $10,000 cash on July 18, 2017.

The Motion to modify McClaine's bail bond was denied by the Court.

Criminal charges were filed against McClaine following a 2-month long investigation by the Sawyer County Sheriff's Office, the Washburn County Sheriff's Office and the Wisconsin Department of Justice, Division of Criminal Investigation.

On August 4, 2017, DrydenWire.com reported that McClaine has been charged in Sawyer County Circuit Court with 2 counts of Class F Felony Manufacture/Deliver Amphetamine and 1 count of Class F Felony Possession with Intent/Amphetamine.

The Sawyer County Sheriff's Office issued a press release on July 19, 2017, which stated that in the course of the investigation, methamphetamine was purchased from McClaine and that when he was arrested, he was in possession of methamphetamine.

According to public record, McClaine has requested a substitute judge on his case. A new court date will be scheduled once a new judge is assigned to the case.

Shell Lake Man Charged with Trafficking Meth Following Sawyer County Investigation

A Shell Lake man has been charged in Sawyer County Circuit Court following a 2-month long methamphetamine trafficking investigation.

According to public record, Daniel McClaine has been charged with 2 counts of Class F Felony Manufacture/Deliver Amphetamine, and 1 count of Class F Felony Possession with Intent/Amphetamine.

A press release issued by the Sawyer County Sheriff's Office on July 19, 2017, stated in the course of their investigation, methamphetamine was purchased from McClaine and that when he was arrested, he was in possession of methamphetamine.

On July 18, 2017, McClaine was placed on a $10,000 cash bond. Public record indicates that McClaine appeared on August 3, 2017, in Sawyer County Circuit Court. A preliminary examination hearing was scheduled, however, McClaine's defense attorney was not able to be present, so the hearing will be held on another date.

If convicted as charged, McClaine could face a maximum of 12 years and 6 months confinement in state prison on each count.

McClaine remains in the custody of the Sawyer County Sheriff's Office at the time of this post.

On June 17, 2017, Sawyer County Sheriff's Deputies arrested Daniel D. McClaine, age 48, of Shell Lake, WI. The arrest was a result of a two-month-long investigation into McClaine's alleged involvement in the trafficking of Methamphetamine in Sawyer County. During the investigation, methamphetamine was purchased from McClaine and he was found to be in possession of methamphetamine at the time of his arrest. You are advised that a defendant is presumed innocent until and unless proven guilty.

The investigation was conducted by the Sawyer County Sheriff's Office, The Washburn County Sheriff's Office and the Wisconsin Department of Justice, Division of Criminal Investigation. The case is being prosecuted by the Sawyer County District Attorney's Office.
