Jeremy Mosay, of Shell Lake, WI, has been sentenced to serve 18 months incarceration in state prison on his conviction of 5th Offense Operating While Intoxicated (OWI).
DrydenWire.com reported in June 2017 (see previous post below) that Shell Lake, WI man Jeremy Mosay was facing charges of 5th offense OWI following an incident in Cumberland, WI in which a caller reported to the Cumberland Police Department that a red car was racing up and down the street in Berdan Trailer Park. A preliminary test of Mosay’s breath alcohol gave a result of .126.
According to online circuit court records, at a hearing in Barron County Circuit Court in February 2018, Mosay entered a plea of guilty to his charge of 5th Offense OWI. Other charges of Misdemeanor Operate While Revoked and 5th Offense Operating with Prohibited Alcohol Concentration were dismissed but read in.
On April 17, 2018, Mosay was sentenced to 3 years and 6 months for his conviction. Mosay is to serve 1 year and 6 months initial confinement in state prison, followed by 2 years of extended supervision. Mosay received credit for 248 days served in county jail. Conditions of Mosay’s extended supervision require him to maintain absolute sobriety and complete any and all evaluations, counseling, treatment and follow-up as recommended by his probation agent.

Shell Lake Man Charged With OWI 5th Offense

A Shell Lake man has been charged in Barron County Circuit Court with Operating While Intoxicated (OWI), 5th Offense, a Class G Felony.
According to the criminal complaint, the Cumberland Police Department was dispatched regarding a call of a red car racing up and down the street in the Berdan Trailer Park, located in the City of Cumberland, WI.
When the officer arrived, the caller showed him the red car in question which then drove towards the officer, so the officer activated the emergency lights on his squad car and conducted a traffic stop.
The driver of the vehicle was identified as Jeremy Mosay, of Shell Lake, WI. Barron County Dispatch advised the officer that Mosay was on probation and under conditions to not consume any alcohol. Due to having 4 prior convictions for OWI, Mosay also is limited to the legal requirement of a blood alcohol level of not greater than .02.
The criminal complaint states that Mosay spoke with the officer and denied consuming alcohol. Mosay attempted to complete field sobriety testing but was unable to successfully do so. The officer then administered a preliminary breath test (PBT) on Mosay, the result of which was .126.
Mosay was placed under arrest at that time, and later a sample of his blood was obtained and then forwarded to the Wisconsin State Hygiene Lab for testing.
The criminal complaint further states that Mosay was also charged with Misdemeanor Operating While Revoked, due to his driver's license being revoked after a prior conviction for operating while intoxicated.
The maximum penalty for 5th Offense OWI is 10 years imprisonment.
Public record shows that Mosay appeared in Barron County Circuit Court for his Initial Appearance on June 12, 2017, regarding his charges. The court placed Mosay on $500 cash bail bond with an additional requirement that he submit to daily PBT's at the Washburn County Sheriff's Office or the Shell Lake Police Department. Mosay is scheduled to appear again on June 21, 2017.
