BARRON COUNTY -- The Court has sentenced Xavier Santiago Torres, of Rice Lake, WI, on multiple convictions from two Barron County Circuit Court cases.
DrydenWire.com published a post in May 2021 regarding the arrest of Torres following a domestic violence incident in Rice Lake, WI where it was reported that the suspect had a firearm in the residence.
The victim and children were able to leave the residence and go to safety according to information from the Rice Lake Police Department. Law enforcement contacted Torres by phone and negotiated with him for some time, however, ultimately oleoresin capsicum spray had to be used due to Torres resisting attempts to take him into custody.
Charges were filed against Torres the day after his arrest including Class I Felony Domestic Substantial Battery-Intend Bodily Harm; Class H Felony Attempt Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer; two counts of Misdemeanor Resisting or Obstructing an Officer; and Class H Felony Bail Jumping. Torres was already facing charges of Felony 3rd Degree Sexual Assault in a separate case that had been filed against him in October 2020. Details of that case are not known to DrydenWire at this time.
Online circuit court records show that Torres appeared most recently in Barron County Circuit Court on October 19, 2021, for a sentencing hearing on convictions for Class I Felony Domestic Substantial Battery-Intend Bodily Harm; Class H Felony Attempt Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer; Class H Felony Bail Jumping-Felony; and an amended charge of Misdemeanor 4th Degree Sexual Assault. The remaining charges against Torres were dismissed but read in at a hearing in June 2021.
Torres received a sentence of 2 years for his conviction of Class I Felony Domestic Substantial Battery-Intend Bodily Harm; 1 year of initial confinement in State Prison, to be followed by 1 year of extended supervision. For his conviction of Class H Felony Attempt Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer, the court ordered another sentence of 2 years; 1 year of initial confinement to be followed by 1 year of extended supervision. Regarding his conviction for Class H Felony Bail Jumping-Felony, the court ordered a 6-year sentence; 3 years of initial confinement followed by 3 years of extended supervision. These sentences are to be served concurrently.
Torres received a sentence of 9 months in county jail for his conviction of Misdemeanor 4th Degree Sexual Assault with credit for 6 days served in confinement. That sentence is to be served consecutively to his other sentences. Torres will also be required to register as a sex offender for 15 years.
Conditions of his extended supervision will require Torres to complete any and all evaluations, counseling, treatment, and follow-up recommended by his Department of Corrections Probation Agent.
