BURNETT COUNTY - A traffic stop in Siren, WI on February 14, 2020, has resulted in felony charges for Webster, WI man, Chance Marlow.
Shortly after 12a on February 14, a St. Croix Tribal Police Officer observed a man in the Siren, WI Holiday gas station who appeared to be intoxicated and stumbling. The Officer saw the man leave the gas station in a gold-colored SUV. One of the vehicle’s headlights was not operating correctly, and the Officer conducted a traffic stop on the vehicle.
The Officer noticed a heavy odor of intoxicants when he approached the vehicle. The driver of the vehicle identified himself as Chance. When the Officer asked Marlow where he was coming from, it took 3 times before the Officer could understand that Marlow was saying he had come from Webster.
Officers noticed open beer containers in the vehicle and asked Marlow to get out of the vehicle. Field sobriety tests were conducted with Marlow and the Officer noticed numerous clues of impairment. Marlow provided a preliminary breath test and the result was 0.32.
Marlow was taken into custody and after he declined to provide a voluntary sample of blood for testing, a search warrant was obtained. Officers transported Marlow to the Burnett Medical Center for a blood draw. During the ride to the hospital, Marlow said that he was going to punch the Officer in the face when he got the chance.
While at the hospital, Marlow fought with 4 Law Enforcement Officers before ultimately complying with the blood draw. Results of that blood testing were not included with the criminal complaint at the time of this post.
Due to his level of intoxication, Marlow had to be medically cleared by hospital staff, after which he was transported to the Burnett County Jail where he allegedly became agitated and aggressive with Law Enforcement during the booking process.
Marlow was previously convicted of Operating While Intoxicated on September 5, 1997, in Minnesota; on February 4, 2004, in Burnett County; and on September 23, 2004, in Polk County.
At a hearing on February 14, 2020, the Court placed Marlow on a $1,500 cash bail bond with a requirement that he maintain absolute sobriety. Marlow made an initial appearance on February 26, 2020, while in custody, and is scheduled to appear again in March 2020.
Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
